MadKidGames.com respects the intellectual property rights of others and expects its users and developers to do the same. It is our policy to respond to clear and properly formatted notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. Overview

MadKidGames.com is a community-driven HTML5 gaming platform that allows independent developers to upload, host, and monetize games. We do not knowingly permit the upload or distribution of content that infringes intellectual property rights. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a DMCA Takedown Notice to our Designated Agent.

2. How to File a DMCA Takedown Notice

To file a valid DMCA Takedown Notice with us, you must provide a written communication that includes the following information:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
Identification of the copyrighted work claimed to have been infringed;
Identification of the material that is claimed to be infringing and where it is located on our platform (include game URLs or page links);
Your contact information, including your name, mailing address, telephone number, and email address;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. What Happens After Filing

Upon receiving a valid DMCA notice, we will:

Promptly remove or disable access to the allegedly infringing material;
Notify the developer or user responsible for the content (the “alleged infringer”);
Provide instructions to the developer on how to submit a counter-notification if they believe the removal was a mistake.

4. Submitting a DMCA Counter-Notification

If you are a developer or user and believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a DMCA counter-notification. Your counter-notification must include the following:

Your physical or electronic signature;
Identification of the content that was removed or disabled and the location where it previously appeared;
A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification;
Your name, address, telephone number, and email address;
A statement that you consent to the jurisdiction of the federal court in your district (or if outside the U.S., the jurisdiction of the courts in which MadKidGames.com is located), and that you will accept service of process from the person who submitted the original DMCA notice.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we maintain a policy that terminates, in appropriate circumstances, users and developers who are repeat infringers. We also reserve the right to disable or delete content and suspend accounts even for a single act of infringement at our discretion.

6. Developer Responsibility

As a multi-developer platform, MadKidGames.com relies on the integrity and legality of uploaded content. Developers must:

Own the full rights to the games, graphics, music, and code they upload;
Not use copyrighted assets (such as sprites, sounds, or brand logos) without proper licenses or permission;
Agree to indemnify MadKidGames.com from any claims arising from their uploaded content.
